Getting a record expunged means that employers, landlords, and anyone else other than law enforcement would not see that the person has been convicted of a crime.
According to the Oakland County expungement lawyer, “In 2021, Governor Whitmer signed the Clean Slate Law into law in response to the growing concern over the lingering effects of a felony conviction. This recognizes that people can make mistakes and that a misstep or two along the way shouldn’t impact the rest of their life. Thus, most misdemeanor and felony convictions are eligible for expungement under the new law.”
The lawyer says that not all people are eligible for their records to be expunged. Checking the criminal record of a person is the first step in determining eligibility. As long as a person doesn’t have any record of a felony even with a number of misdemeanors, they will be eligible for expungement.
Attorney Paul Tafelski also states that an individual can only have up to three felonies they wish to be eligible for an expungement. A conviction for multiple offenses is considered a single conviction under the new law as long as they occurred in the same 24-hour period.
“Once you determine that you qualify based on your record, you next need to check if the convictions you seek to expunge are eligible. In other words, even if you only have a single conviction, you might not qualify based on the nature of the crime for which you were convicted. For example, a conviction for any crime punishable by life in prison cannot be expunged,” says attorney Tafelski.
